OVERVIEW
Welcome to Cedar Cards Canada.
Cedar Cards Canada is operated by 17490801 Canada Inc. Throughout these Terms of Service, the terms “Cedar Cards Canada,” “we,” “us,” and “our” refer to 17490801 Canada Inc., operating as Cedar Cards Canada.
We operate this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced in them, govern your access to and use of the Services and any purchases you make from Cedar Cards Canada.
Please read these Terms carefully. They contain important information concerning your legal rights and obligations, including provisions relating to shipping, returns, warranties and limitations of liability.
By accessing or using the Services or placing an order with Cedar Cards Canada, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you should not access or use the Services.
Nothing in these Terms is intended to exclude, restrict or waive any rights or remedies that cannot lawfully be excluded, restricted or waived under applicable law.
SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS
By using the Services, you represent that you have reached the age of majority in your province, state or country of residence, or that you have reached the age of majority and have consented to the use of the Services by any minor dependants under your supervision.
You may be required to provide information including your name, email address, billing information, payment information and shipping address when using the Services or placing an order.
You represent that all information you provide to Cedar Cards Canada is accurate, current and complete and that you have the authority to provide that information.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign or license your account to another person.
We reserve the right to refuse service, suspend accounts or restrict access to the Services where reasonably necessary to protect Cedar Cards Canada, our customers, Shopify, payment providers or other parties from fraud, abuse, unlawful activity or violations of these Terms.
SECTION 2 — PRODUCTS, COLLECTIBLES AND PRODUCT INFORMATION
Cedar Cards Canada sells products that may include trading cards, collectible card game products, sealed products, individual cards, accessories, storage products and other collectibles.
We make reasonable efforts to ensure that product descriptions, photographs, prices, availability and other information displayed through the Services are accurate. However, errors or differences may occasionally occur.
Images are provided for identification and illustrative purposes. Colours, finishes, foiling, textures and other visual characteristics may appear differently depending on lighting, photography, display settings and the device used to view the Services.
Unless a listing expressly states that the exact item pictured will be supplied, product images may be representative of the product rather than photographs of the specific individual item that you will receive.
Packaging for sealed products and accessories may differ from images displayed on the website where manufacturers change packaging, labelling or product presentation without materially changing the underlying product.
We reserve the right to correct product information, update descriptions, limit quantities, discontinue products or restrict sales to particular persons, geographic regions or jurisdictions where reasonably necessary.
SECTION 3 — TRADING CARD CONDITION AND GRADING
The condition of collectible trading cards can involve a degree of subjective judgment.
When Cedar Cards Canada provides a condition description for an individual card, we make reasonable efforts to assess and describe that card accurately and in good faith.
Minor manufacturing variations, print lines, centering differences, surface imperfections, edge or corner characteristics and similar features may exist even on cards described as being in excellent or near-mint condition.
Unless expressly stated otherwise, a condition description provided by Cedar Cards Canada is not a professional third-party grade and is not a guarantee that a card will receive any particular grade from PSA, Beckett, CGC, TAG or any other grading company or authentication service.
Different grading companies, dealers and collectors may apply different standards or reach different conclusions regarding the same card.
Where photographs of the specific card are included in a listing, customers should review those photographs before purchasing.
Third-party graded or authenticated cards are sold based on the grade and/or authentication assigned by the applicable third-party service. Cedar Cards Canada does not control or guarantee the accuracy, consistency or future acceptance of a grade assigned by an independent grading company.
SECTION 4 — SEALED PRODUCTS
Products described as sealed are sold in their original sealed condition to the best of our knowledge.
Cedar Cards Canada does not manufacture trading cards and does not control the contents, collation, print quality, pull rates, card distribution or manufacturing characteristics of sealed products.
Unless expressly guaranteed in the product listing, purchasing a sealed trading card product does not guarantee that it will contain any particular card, rarity, treatment, foil, serialized card or other collectible.
Manufacturer defects, collation errors, missing components or similar issues originating during manufacturing may be subject to the manufacturer's policies where applicable.
Once a sealed product has been opened, unwrapped, unsealed or otherwise materially altered from the condition in which it was supplied, it may not be eligible for return except where required by applicable law or expressly permitted under our Refund Policy.
SECTION 5 — ORDERS AND ACCEPTANCE
Submitting an order constitutes an offer to purchase the products included in that order.
An automatically generated order confirmation or payment authorization does not necessarily constitute final acceptance of your order.
Cedar Cards Canada reserves the right to accept, reject or cancel an order where reasonably necessary, including in circumstances involving suspected fraud, payment issues, inventory errors, pricing errors, product availability, quantity restrictions, shipping restrictions or other errors affecting the transaction.
Payment must be successfully authorized and processed before an order can be fulfilled.
If we cancel an order after payment has been collected, we will refund the applicable amount using the original payment method where reasonably possible.
Please review your order carefully before submitting it. Once an order has entered processing or has been shipped, we may be unable to modify or cancel it.
We may limit or cancel quantities purchased per person, household, account, payment method or order where we reasonably believe that doing so is necessary to prevent fraud, abuse, manipulation of promotions or other improper purchasing activity.
SECTION 6 — PRICING, CURRENCY AND PAYMENT
Prices, discounts, promotions and product availability may change without notice.
The price applicable to an accepted order will generally be the price displayed when the order was placed, subject to correction of obvious errors or inaccuracies as permitted by applicable law.
Unless otherwise stated, prices displayed by Cedar Cards Canada are expressed in Canadian dollars or in the currency selected or displayed through the store.
Taxes, shipping charges, duties, tariffs, brokerage fees and other charges may be additional unless expressly stated otherwise.
You agree to provide current, complete and accurate billing, payment and account information.
By providing a payment method, you represent that you are authorized to use that payment method and authorize us and our payment service providers to charge the amounts associated with your purchase.
Cedar Cards Canada may use third-party payment processors. Your payment information may therefore be processed by those providers in accordance with their applicable terms and privacy policies.
SECTION 7 — SHIPPING, DELIVERY AND TRANSFER TO CARRIER
Orders are shipped using the shipping service selected or otherwise applicable to the order. Available services may include tracked parcel services, registered mail and other postal or courier services.
Delivery dates and transit times displayed or communicated by Cedar Cards Canada or a shipping carrier are estimates unless expressly stated otherwise. We do not guarantee delivery by a particular date.
Once an order has been accepted by the shipping carrier, the package is considered to be in the custody of the carrier.
To the fullest extent permitted by applicable law, Cedar Cards Canada is not responsible for carrier delays, loss, theft, misdelivery or damage occurring while a package is in the carrier's possession. Risk associated with shipment transfers to the customer when the order is transferred to the carrier, subject to any rights or remedies that cannot be excluded under applicable law.
Where tracking, delivery confirmation, registration information or other shipment information is available, it may be provided to the customer.
Customers are responsible for providing a complete and accurate shipping address. Cedar Cards Canada is not responsible for delivery problems resulting from incorrect, incomplete or outdated address information supplied by the customer.
If a shipment is returned to Cedar Cards Canada because of an incorrect address, refusal of delivery, failure to collect the shipment, unpaid import charges or another circumstance attributable to the customer, additional shipping charges may apply before the order is reshipped. Refunds, if any, will be handled in accordance with our Refund Policy and applicable law.
If an issue occurs during transit, please contact us. Cedar Cards Canada can provide available shipment information and, where applicable, assist with opening a carrier investigation or claim. Any assistance provided does not constitute an acceptance of liability for the shipment.
Our Shipping Policy forms part of these Terms and provides additional information concerning shipping and delivery.
SECTION 8 — INTERNATIONAL ORDERS, CUSTOMS, DUTIES AND IMPORT CHARGES
Customers placing orders for delivery outside Canada are responsible for determining whether the products ordered may lawfully be imported into the destination country.
The customer is solely responsible for any customs duties, tariffs, VAT, import taxes, brokerage fees, handling charges, clearance charges or other fees imposed by the destination country, customs authority, postal service or shipping carrier unless expressly stated otherwise at checkout.
These charges are not included in the purchase price or shipping charges paid to Cedar Cards Canada unless expressly stated otherwise.
Customers are responsible for communicating with the applicable carrier and/or customs authority, supplying any information or documentation required for importation, paying applicable charges and arranging for the release, delivery or pickup of their shipment.
Cedar Cards Canada is not responsible for delays, returns, seizures, abandonment or other issues resulting from unpaid import charges, import restrictions, incomplete customs requirements or a customer's failure to respond to a carrier or customs authority, except to the extent otherwise required by applicable law.
Customs authorities may inspect packages and may require information regarding the contents and value of a shipment. Cedar Cards Canada will not knowingly falsify customs declarations, product values, invoices or other shipping documentation.
SECTION 9 — RETURNS, REFUNDS AND EXCHANGES
Returns, refunds, exchanges and order cancellations are governed by our Refund Policy, which forms part of these Terms.
Certain products may be final sale or subject to return restrictions because of their collectible nature, condition, market-price volatility, sealed status or other characteristics. Any such restrictions will be described in our Refund Policy or applicable product listing.
Nothing in our Refund Policy or these Terms limits any refund, cancellation, return or other consumer right that cannot lawfully be excluded.
SECTION 10 — PRE-ORDERS
Products identified as pre-orders are products offered for purchase before their anticipated release or availability date.
Release dates, allocation quantities and delivery schedules for pre-order products may be determined by manufacturers, publishers, distributors or other third parties and may change without notice.
Any release date or estimated availability date displayed by Cedar Cards Canada is an estimate unless expressly guaranteed.
We are not responsible for delays caused by manufacturers, publishers, distributors, carriers or other circumstances outside our reasonable control.
If Cedar Cards Canada is unable to fulfil a pre-order because inventory allocated to us is cancelled or materially reduced, we may cancel the affected quantity and refund the amount paid for the unfulfilled product.
Additional pre-order conditions may be stated on the applicable product page and will form part of the agreement for that purchase.
SECTION 11 — MARKET PRICES AND COLLECTIBLE VALUES
Trading cards and collectible products may fluctuate significantly in market value.
Prices may increase or decrease after an order is placed due to market conditions, product availability, tournament results, announcements, reprints, collectability, supply and demand or other factors.
Except as required by applicable law or our Refund Policy, a change in the market value of a product after purchase does not entitle a customer to a refund, price adjustment, cancellation or additional payment.
Cedar Cards Canada does not provide investment, financial or valuation advice and makes no representation that any collectible will maintain or increase its value.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, inventory, shipping charges, transit times or availability.
We reserve the right to correct errors, inaccuracies or omissions and to update information where appropriate.
If a material error affects an order that has already been submitted, we may contact you to correct the order or cancel and refund the affected transaction where permitted by applicable law.
Nothing in this section limits any rights you may have under applicable consumer protection legislation.
SECTION 13 — INTELLECTUAL PROPERTY
The Services and their original content, including text, graphics, logos, website design, photographs, videos and other materials created by or for Cedar Cards Canada, are owned by Cedar Cards Canada or its applicable licensors and are protected by Canadian and applicable international intellectual property laws.
These Terms permit you to access and use the Services for lawful personal use.
Except as permitted by law or with our prior written consent, you may not reproduce, distribute, modify, republish, commercially exploit or create derivative works from content owned by Cedar Cards Canada.
References to third-party trading card games, publishers, manufacturers, artists, characters, card names, trademarks, logos and other intellectual property remain the property of their respective owners.
Unless expressly stated otherwise, the sale of third-party products by Cedar Cards Canada does not imply sponsorship, endorsement, affiliation or ownership of the intellectual property associated with those products.
Shopify's name, trademarks and other intellectual property belong to Shopify or its licensors.
SECTION 14 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may provide access to tools, applications, payment services, integrations or functionality provided by third parties.
We may not monitor or control those third-party services.
To the extent permitted by applicable law, third-party tools are made available on an “as is” and “as available” basis without warranties or endorsements by Cedar Cards Canada.
Your use of third-party services may be governed by separate terms and privacy policies imposed by the applicable provider.
We may introduce new tools, resources or features through the Services. Unless otherwise stated, those features will form part of the Services and be subject to these Terms.
SECTION 15 — THIRD-PARTY LINKS
The Services may contain links to websites, resources or services operated by third parties.
Cedar Cards Canada does not control those third parties and is not responsible for their content, availability, security, products, services, policies or practices.
Accessing a third-party website is at your discretion and may be subject to the third party's own terms and privacy policies.
Questions or disputes relating solely to products or services purchased directly from a third party should be directed to that third party.
SECTION 16 — RELATIONSHIP WITH SHOPIFY
Cedar Cards Canada is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and Cedar Cards Canada.
By using the Services, you acknowledge that Shopify is not the seller of products purchased from Cedar Cards Canada and, to the fullest extent permitted by applicable law, Shopify is not responsible for the sale, fulfilment, condition or delivery of products sold by Cedar Cards Canada.
You release Shopify and its affiliates from claims arising directly from transactions between you and Cedar Cards Canada to the fullest extent permitted by applicable law.
SECTION 17 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is powered by Shopify, certain personal information may also be collected, processed or stored by Shopify in accordance with Shopify's applicable privacy policies.
Information may also be shared with payment processors, shipping carriers and other service providers where reasonably necessary to process payments, fulfil orders, provide customer service, prevent fraud and operate our business.
Please review our Privacy Policy for additional information about how personal information is collected, used, disclosed and protected.
SECTION 18 — REVIEWS, FEEDBACK AND USER CONTENT
If you submit reviews, photographs, comments, suggestions, ideas or other content to Cedar Cards Canada (“Feedback”), you represent that you have the right to provide that Feedback.
By submitting Feedback for publication or promotional use, you grant Cedar Cards Canada a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, display, distribute and adapt that Feedback for purposes connected with operating, improving and promoting Cedar Cards Canada and the Services.
You remain responsible for the content and accuracy of your Feedback.
Feedback must not infringe the rights of another person, contain unlawful or defamatory material, impersonate another person, contain malicious software or deliberately mislead others.
We may moderate, refuse or remove Feedback that we reasonably believe violates these Terms or applicable law.
SECTION 19 — PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services to:
- violate applicable laws or regulations;
- engage in fraud or other deceptive activity;
- infringe the intellectual property or other rights of Cedar Cards Canada or another person;
- harass, threaten, abuse or unlawfully harm another person;
- submit false or misleading information;
- impersonate another person or entity;
- transmit viruses, malware or other harmful code;
- interfere with the security or proper operation of the Services;
- scrape, crawl or systematically extract data from the Services in a manner that violates applicable law or our rights;
- collect personal information about other users without authorization;
- engage in phishing, spam or similar abusive activity; or
- attempt to circumvent fraud-prevention, security, purchasing or account restrictions.
We may suspend or terminate access to the Services where we reasonably determine that these Terms have been violated.
SECTION 20 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Cedar Cards Canada does not guarantee that the website or Services will always be uninterrupted, secure, error-free or available.
Except for warranties, conditions, representations or rights that cannot lawfully be excluded, we disclaim express and implied warranties and conditions relating to the Services and products sold through them, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose and non-infringement.
Nothing in these Terms excludes or restricts a warranty, condition, guarantee or consumer right that applies by law and cannot legally be waived or excluded.
SECTION 21 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Cedar Cards Canada and its directors, officers, employees, agents, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential damages, including lost profits, lost revenue, lost savings, loss of data or loss of opportunity arising from your use of the Services or purchase of products from Cedar Cards Canada.
Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
Nothing in this section limits any mandatory rights or remedies available to consumers under applicable consumer protection legislation.
SECTION 22 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Cedar Cards Canada, 17490801 Canada Inc., Shopify, and our respective affiliates, directors, officers, employees, agents, contractors, licensors and service providers from third-party claims, losses, liabilities, damages and reasonable legal fees arising from:
- your material breach of these Terms;
- your violation of applicable law;
- your infringement of another person's rights; or
- your unlawful or unauthorized use of the Services.
This provision does not require you to indemnify any party for liability arising solely from that party's own unlawful conduct or negligence where such an indemnification would be prohibited by applicable law.
SECTION 23 — TERMINATION
You may stop using the Services at any time.
We may suspend or terminate your access to all or part of the Services if you materially violate these Terms, engage in fraud or unlawful activity, abuse the Services or where suspension or termination is reasonably necessary to protect Cedar Cards Canada, our customers or our service providers.
Termination does not eliminate obligations or liabilities that arose before termination.
Provisions that by their nature are intended to survive termination, including provisions concerning intellectual property, liability, indemnification, governing law and outstanding payment obligations, will continue to apply.
SECTION 24 — SEVERABILITY
If any provision of these Terms is determined by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, severed from these Terms.
The remaining provisions will continue in full force and effect.
SECTION 25 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Cedar Cards Canada concerning your use of the Services and purchases from our store.
If product-specific or promotion-specific terms expressly conflict with these Terms, the more specific terms will govern the applicable product or promotion to the extent of that conflict, subject to applicable law.
SECTION 26 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, reorganization, sale of the business or assets, corporate restructuring or similar transaction, subject to applicable law.
SECTION 27 — GOVERNING LAW AND JURISDICTION
These Terms and any dispute arising from or relating to the Services or a purchase from Cedar Cards Canada will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Subject to any rights you may have under applicable consumer protection laws, you and Cedar Cards Canada agree to submit to the jurisdiction of the courts of Ontario in relation to disputes arising from these Terms or the Services.
Nothing in this section deprives a consumer of any mandatory protection or right to bring proceedings in another jurisdiction where applicable law prohibits such a restriction.
SECTION 28 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, Services, policies, technology or applicable legal requirements.
The current version of the Terms will be available on our Terms of Service page.
Where required by applicable law, we will provide notice of material changes.
Changes will apply from their stated effective date and will not retroactively alter rights or obligations relating to transactions completed before that date except where permitted or required by law.

Section headings are provided for convenience and organization only and do not affect the interpretation of these Terms.
